Terms and Conditions of Sale: June 2003

All orders are accepted by Acorn Fasteners Ltd subject to the terms and conditions of Sale set out below

1. General

All orders for products and services in this web site are accepted by Acorn Fasteners LTD ('AF') subject to these terms and conditions of sale. No other terms will apply to the supply of products and services by AF unless agreed in writing by an authorised signatory of AF.

All information concerning the products and services contained on this web site shall not form any part of the contract between AF and the customer. AF may correct any errors in this web site without liability to the customer.

2. Prices

The prices for the products and services are as set out in the AF web site that is current at the date of dispatch. All prices exclude VAT, which AF will add at the rate applicable at the date of invoice. Whilst AF will try to maintain the prices quoted in this web site, AF reserve the right to change them without prior notice at any time before dispatch.

3. Ordering

AF reserve the right to decline any order placed by any company or person, whether or not payment has been received, by giving notice of non-acceptance by e Mail or Telephone within 24 hours (Excluding weekends and Bank Holidays) of receipt of the order. If AF declines to accept an order where payment has been received, AF will refund the payment in full.

AF action orders to the customers requirements and do not substitute one product for another unless requested by the customer. If the order is unable to be completely satisfied from stock, a member of staff will inform the customer by return e Mail of the situation and offering an alternative item, a date for which the stock is expected or Customer to cancel the item. Please note that the remaining balance of the order will not be dispatched until the e Mail has been responded to by the customer.

4. Delivery

AF aim to deliver all order the next working day.

4.1 Free next day delivery. AF are currently running a promotion offering this service, AF reserve the right to cancel this promotion without any prior notice to the customer up to the date of dispatch.

4.2 Order received by AF between 8.00 am and 15.00 PM on Monday to Thursday will be shipped on a next day delivery service, orders received after 15.00 PM will be dispatched the following day on the same service. Orders received on Friday between 8.00 am and 12.00 am will be dispatched on an next day service, any order received after this will be dispatched on the next working day. Any orders that are received over the weekend or bank holidays will be dispatched on an next day service on the next working day.

4.3 Next day delivery costs are set by AF and can be altered at any time up to the date of despatch.

Order less than @ £ 50.00 in value will be charged carriage at @ £ 7.50 + VAT

Orders less than @ £ 150.00 in value will be charged carriage at @ £ 15.00 + VAT

Orders less than @ £ 250.00 in value will be charged carriage at @ £ 20.00 + VAT

Any orders over the value of @ £ 250.00 carriage will be FREE of CHARGE

5. Delivery delays and Non-Delivery

The customer must check the goods as soon as is reasonably possible after delivery and shall, within 10 days of the date of delivery give notice to AF in detail of:

Any defect that is apparent on reasonable inspection. In this case AF shall either replace the product or refund the purchase price.

The customer must refuse to accept any delivery of parcels that can be seen to be damaged.

Any shortfall in the product delivered, in this case AF at its discretion, will deliver the shortfall or refund the price for the undelivered product.

Any products that are delivered which are not in accordance to the order. AF shall at AF discretion, replace the product or refund the purchase price.

If the customer fails to give any such notice, the products shall be conclusively presumed to be, in all respects, in accordance with the order and free from apparent defect, and the Customer shall be deemed to have accepted the products accordingly.

The customer must notify AF of any Non-delivery no later than 7 days after the order has been acknowledge by AF. In this case at AF sole discretion the customers exclusive remedy shall be redelivery of the products or refund or credit of the purchase price.

AF shall not be liable for any other losses, consequential or otherwise, arising from non-delivery or late delivery.

6. Payment

If AF has not granted credit to the customer, payment terms are cash with order. Orders will not be despatched until payment has been made.

Credit terms subject to satisfactory references are available. If credit has been granted, the Customer shall pay the total price on the 30th day of the month following the month in which the products are dispatched.

7. Return

The customer may only return products to AF for a refund or credit with the prior consent of AF.

8. Cancellations

The customer may not cancel orders once they have been accepted by AF. Any cancellation or part cancellation of an order must be received in writing and acknowledge prior to the goods been dispatched., The terms of which will indemnify AF against any expense incurred by AF.

9. Copyright

The customer acknowledges that AF owns the copyright in this web site, and that its whole or partial reproduction without AF's prior written consent is prohibited.

10. Laws and Jurisdiction

The contract between AF and the Customer shall be governed by and interpreted in accordance with English law and the Customers submits to the jurisdiction of the High Court of Justice in England, but AF may enforce the contract in any court of competent jurisdiction.
